Terms of service
Pindash is for business or professional use. You can read these terms without signing up. When you use the app, you accept, in this order:
- The sign-up terms, when you create your account and start the 14-day trial.
- The service agreement and the Data Processing Agreement, which you sign on screen before connecting a store. That agreement is reproduced below.
- The plan’s financial terms (plan, billing period, price including taxes and date of the first charge), in a separate step, only if you decide to subscribe. Current prices and limits are on the Pricing page.
The signed copy you receive by email and can find in your account, under Settings → Legal documents, is the one that governs your agreement. The Spanish version prevails over this translation.
Pindash Service Agreement
Version 1.3 · approved. This is the model signed in the app before connecting a store.
In short: Pindash gives you access to a read-only sales dashboard for your stores. During the 14-day trial, counted from when you sign up, you pay nothing and no card is needed; signing does not extend or restart the trial. If you later choose a plan, you will see and accept its price, billing period and first charge date before you pay, and we keep that offer exactly as you accepted it. The Pindash connection only reads your store. If you install the optional Pindash module for PrestaShop, it can connect your store in one click and, if you turn it on, store in your store the source of each order, as its annex explains, without changing products, prices, amounts or payments. You can export your figures and request your data when you leave. The processing of your buyers’ data is governed by the Data Processing Agreement, which you sign at the same time.
This English text is a translation of the Spanish original, version 1.3. If the two differ, the Spanish version prevails.
Parties
Provider: BIERZO SEO Y MARKETING S.L., tax ID (CIF) B24730178, registered in the Registro Mercantil de León, hoja LE-26008, folio 177, tomo 1343, inscripción 1.ª, with registered office at C. General Gómez Núñez, 2, planta 1, oficina 2, 24402 Ponferrada (León), España.
Customer: the person or entity that holds the account, with the details they provide when signing.
Signer: the person who signs on behalf of the Customer, identified when signing.
1. Purpose
Pindash is a cloud service that reads, with read-only permissions, the orders and business data of the PrestaShop or WooCommerce stores the Customer connects, and shows the Customer sales figures, alerts and summaries. In PrestaShop stores, the Customer may also install an optional Pindash module to learn the source of orders (clause 6). This agreement governs the use of the service during the trial and, where applicable, during any plan the Customer subscribes to afterwards.
2. Business use
The Customer declares that it subscribes to Pindash for its business or professional activity. Anyone signing on behalf of another person or entity declares that they have sufficient authority to enter into this agreement and to authorize the connection of that person’s or entity’s stores and the data processing described in the Data Processing Agreement.
3. How this agreement is accepted
There are three separate acceptances, each with its own action: signing up for the account, under its Sign-up Terms; signing this agreement, the Data Processing Agreement and the Pindash PrestaShop Module Annex, before connecting the first store; and, if the Customer decides to do so later, subscribing to a paid plan (clause 5). Using the application is not the same as signing. The Module Annex only applies if the Customer installs the module; if not, it imposes no obligations on the Customer and does not authorize any processing. A new version of this agreement, the Data Processing Agreement or the annex is accepted with the same signature process (clause 14).
Signing takes place in the application: the Signer reviews the full texts with their details and confirms with a one-time code sent to their email. This is a simple electronic signature. As evidence, Pindash keeps the exact version and content signed, its integrity fingerprint (hash), the declared identity and representation, the verified account and email, the date and time, and the result of the code verification; the code itself is never stored in plain text. The Customer receives a PDF copy by email and can download it at any time in Settings → Legal documents.
4. Free trial
The trial lasts 14 calendar days from account sign-up. It does not require a card or payment. Signing this agreement, connecting a store or signing later does not restart or extend that period. If the trial ends without a plan being chosen, the account is frozen for 30 days: the Customer can view and export its figures and subscribe to a plan, but no new data is read from its stores. Settings → Plan shows the exact date on which the operational data will be deleted.
5. Subscribing to a plan
Subscribing to a plan is a separate, voluntary step. Before confirming it, the Customer can review and correct the plan and its limits, the monthly or annual billing period, the price, taxes, the total, the date of the first charge and of renewals, and the rules on cancellation, blocking and deletion. Payment is processed through Stripe. If the plan is chosen during the trial, the first charge is made when the original trial ends. This agreement, on its own, does not create any subscription or paid renewal.
Pindash keeps the accepted offer exactly as it was shown (plan, limits, billing period, price, taxes, charge dates and version of the terms) and provides it to the Customer on request. A later change to the published prices does not alter an offer already accepted.
6. How the service works
The Pindash remote connection queries the stores’ data with the read permissions configured by the Customer. If the Customer clicks “Connect with Pindash” in the module, the module sets up the connection in the store (it turns on the webservice and creates a read-only key for Pindash, which it deletes on disconnection or uninstallation), without write permissions over the store’s data. The module installed in the store may also carry out the local attribution operations expressly activated by the Customer: keeping source information in a session cookie, storing it provisionally linked to the cart, adding it as order metadata and deleting the attribution records when their retention periods expire. These operations do not modify the products, prices, cart contents, amounts or payment statuses of orders. The Customer can turn off attribution and revoke the connection as described in the documentation. The Module Annex governs those operations, and attribution does not grant any remote write permissions. The Customer creates the read keys or authorizations and can revoke them at any time. Figures show their period, currency, coverage and update status; pending or partial data is labeled as such. Pindash figures are for information only: they do not replace the Customer’s accounting, invoicing or tax returns.
7. Customer data and confidentiality
The data from the Customer’s stores and the figures Pindash calculates from it belong to the Customer. Pindash only uses them to provide the service to the Customer, does not sell them or use them for other purposes, and treats them as confidential information. The Customer can connect an AI assistant to its account in Settings → AI assistants; the Customer chooses and subscribes to that assistant, decides which stores it can access and can withdraw access whenever it wishes.
8. Customer obligations
The Customer only connects stores it has the right to manage, keeps its Pindash login credentials safe and uses the service in accordance with the law and this agreement. The Customer must not send Pindash administrator passwords by email or through any other channel not provided for that purpose.
9. Support
The first support response is given within one business day, Monday to Friday, 09:00 to 18:00 (Madrid time), except published public holidays. The commitment is to respond, not to resolve the issue within that time.
10. Non-payment and usage over plan limits
If a subscription payment cannot be collected, the service keeps working for 7 days with a warning; after that, access to the data is blocked until the situation is resolved, and once 30 days have passed since the first failed payment without payment being made, the operational data is deleted. If the plan limits are exceeded, the Customer is warned for 30 days to change plans with express acceptance; after that, access is blocked for a further 30 days and, on day 60 without the situation being resolved, the subscription is canceled and the operational data is deleted. When usage exceeds the plan limits, the Customer is warned by email 7 days and 1 day before deletion.
While access is blocked for exceeding the limits, new charges stop and the blocked days are not charged later; when the situation is resolved, the paid time not used is kept and the new plan is only charged after the Customer accepts the calculated amount. During any block, the Customer can go to Settings → Plan to resolve the situation and to Settings → Legal documents to download its documents, but cannot view or export the figures.
11. Term, cancellation and deletion
The agreement lasts as long as the account exists. There are three separate actions:
- Canceling the renewal: the plan stays active until the end of the paid period, with no refund for the current period. After that, the account is frozen for 30 days for viewing and exporting, and the operational data is then deleted.
- Ending the trial without choosing a plan: as provided in clause 4.
- Requesting deletion of the account: the Customer may request it at any time by writing to hello@pindash.pro. The operational data is deleted without waiting for the periods above and, if there was a plan, its renewal is canceled.
In all three cases, this agreement, its signature evidence, the accepted offers and the invoices are kept separately for the applicable legal retention periods, and are not used to continue analyzing buyer data.
12. Exit and portability
While it has access to its figures, the Customer can export them in CSV format from the dashboard. In addition, until the operational data is deleted, the Customer can request at hello@pindash.pro an export of the data from its stores that Pindash holds, which will be delivered in a structured, commonly used format (CSV) within a maximum of 30 days. The export does not reactivate the dashboard or the store reads.
13. Liability
The Provider provides the service with due professional diligence and corrects any calculation errors of its own that are detected. It is not liable for the business decisions the Customer makes based on the figures, and does not guarantee business results. Nor is it liable for the unavailability of the stores or of third-party platforms, unless the damage results from a lack of diligence by the Provider in choosing, integrating or supervising them, or for indirect damages or loss of profits.
Except in cases of willful misconduct or gross negligence, the Provider’s total liability to the Customer is limited to the greater of: the amount paid by the Customer in the twelve months before the event giving rise to the liability, or 300 euros. These limitations do not apply to liabilities that the law does not allow to be limited, and do not affect the rights of data subjects or the Provider’s obligations to the data protection authorities.
14. Changes to this document
When there is a new version of this agreement, the Data Processing Agreement, the Module Annex or the Pindash module for PrestaShop itself, the Provider notifies the Customer by email and sends the Customer the changes it includes in writing. A new version does not silently replace the accepted version. When a new version of this agreement, the Data Processing Agreement or the annex requires acceptance, to keep using Pindash the Customer reviews it and signs it in the same way as the original. Until the Customer does so, it can view and download its documents, export its figures, request the export of its data, and cancel the renewal or request deletion of its account, and Pindash keeps reading its stores within the scope of the version it signed. If the Customer does not accept the new version, it can cancel the renewal: until the end of the paid period, the version it signed continues to apply.
15. Governing law and jurisdiction
This agreement is governed by Spanish law, without prejudice to any applicable mandatory rules. Disputes will be resolved by the courts that have jurisdiction under the applicable procedural rules and rules on international jurisdiction.
16. Language
This agreement is entered into in Spanish. This English translation is provided for the Customer’s convenience; if the two versions differ, the Spanish version prevails.
